Terms of service
1. Who you are contracting with
These terms form the agreement between you and Simvito Limited (Company No. 81210167), a company incorporated in Hong Kong SAR under the Companies Ordinance (Cap. 622), trading as Simvito. In these terms, "we", "us" and "Simvito" mean that company.
By buying or using a Simvito eSIM you accept these terms. If you do not accept them, do not buy or install the product.
2. What we supply
We supply prepaid mobile data plans delivered as eSIM profiles. Connectivity is provided by mobile network operators and eSIM platform partners in each market. Simvito is a reseller of that connectivity and is not itself a licensed mobile network operator.
Plans are data only. They do not include a telephone number, voice calls or SMS unless the plan description explicitly says otherwise.
3. Eligibility and your device
You must be at least 18 years old, or have the consent of a parent or guardian, to buy from us.
Your device must support eSIM and must not be locked to another carrier. Checking this is your responsibility before purchase, and our device page and support team are available to help you check. We are not able to make a plan work on a device that does not support eSIM or that is carrier-locked.
4. Orders, prices and payment
All prices are quoted in US dollars and include applicable tax. The amount shown at checkout is the amount charged.
Payment is processed by our payment service provider. We do not receive or store your full card number. A contract is formed when we send your eSIM, not when you submit the order.
If a price is displayed in error we may cancel the order and refund you in full before delivery. We will tell you if this happens.
5. Delivery
eSIMs are delivered electronically to the email address given at checkout, normally within 5 minutes of successful payment. Nothing is shipped physically.
You are responsible for giving a working email address. If delivery fails because the address was wrong, contact us and we will resend to a corrected address at no charge. Our delivery policy sets this out in full.
6. Activation and validity
Unless the plan description says otherwise, the validity period begins when the eSIM first connects to a network in the destination and runs continuously from that point, including days on which you do not use the phone.
A plan ends when the data allowance is exhausted or the validity period expires, whichever comes first. Unused data has no cash value and is not carried over.
Each QR code may be installed once. A profile that is deleted, or lost because a device is erased or replaced, cannot be reinstalled and is not replaced free of charge.
7. Acceptable use
You may use the service for ordinary personal or business travel use, including personal hotspot.
You may not resell the service, use it for permanent roaming in a country where you are resident, operate it in a fixed device such as a router or camera for continuous machine traffic, send unsolicited bulk messages, or use it for any unlawful purpose.
Where usage is grossly disproportionate to normal travel use, or where a network partner identifies abuse, we may suspend or terminate the plan. Where we do so without good cause we will refund the unused portion.
8. Coverage and service quality
Mobile coverage, speed and network availability are determined by the local operators and by conditions outside our control, including terrain, buildings, network congestion, maintenance and local regulation.
We publish the countries and regions each plan covers, but we cannot guarantee uninterrupted service, a particular speed, or service at a specific location. Nothing in these terms is a warranty of continuous availability.
9. Refunds
Refund rights are set out in our refund policy, which forms part of these terms. In summary: an eSIM that has not been activated is refundable within 30 days of purchase, and a plan that fails for a technical reason we cannot resolve is refundable whether or not it was activated.
10. Our liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our total liability arising out of or in connection with a plan is limited to the amount you paid for that plan.
We are not liable for indirect or consequential loss, including missed connections, lost bookings, lost business or lost data arising from an interruption in service.
11. Privacy
We process personal data in accordance with our privacy policy and with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong.
12. Changes to these terms
We may update these terms. The version published on this page at the time of your purchase governs that purchase, and changes do not apply retroactively to plans already bought.
13. Governing law and disputes
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence.
